- Whether any notice was served at all, and if so, whether it met the statutory requirements
- Whether the landlord took any physical action to remove the tenant before a valid notice period expired or before RTB/court enforcement
- Remedies can include an order for the tenant's reinstatement, or damages
Why this matters to landlords: This is the category to actively avoid ending up in. Self-help eviction โ even against a tenant who is clearly in arrears or overholding โ routinely results in a finding against the landlord, on top of the original issue being unresolved. Always use a validly served notice and the RTB/court enforcement route.
